Terms and conditions
1. Scope
These terms govern the use of iTable, a digital hospitality management system for menus, QR codes, reservations, orders, POS-related workflows, inventory, deliveries and related functions. The provider is iMATRIX GmbH, Cheerstrasse 13e, 6014 Lucerne, Switzerland.
2. Customers and users
Customers are businesses, in particular restaurants, cafés, bars, take-away operators, hotels and hospitality businesses. Users act on behalf of the respective customer when using a customer account.
3. Services
iTable provides technical functions for capturing, managing, displaying and publishing restaurant data. The specific scope depends on the selected package, enabled modules and technical availability. Functions may be developed, adapted or replaced provided that the core benefit remains reasonably preserved.
4. Account and security
The customer is responsible for correct registration data, user management, roles, permissions and secure handling of access credentials. Actions made through a customer account are deemed actions of the customer unless misuse is proven and not attributable to the customer.
5. Responsibility for customer content
The customer is solely responsible for all content, data and information entered, edited, published or made available through iTable by the customer or authorised users. This includes menus, prices, product descriptions, allergens, ingredients, images, logos, trademarks, opening hours, reservations, orders, QR menus, website widgets, contact details and all other public information.
The customer must ensure that its content is accurate, current, complete and lawful, does not infringe third-party rights and complies with applicable information duties, including price, food, allergen, alcohol, youth protection, tax, data protection and consumer protection requirements.
6. Prohibited use
Unlawful content, misleading information, infringement of intellectual property rights, unauthorised access, security circumvention, operational interference, automated attacks, spam, malware or any use that affects the stability, security or reputation of iTable is prohibited.
7. Prices and payment
Prices, package contents, terms, payment methods and cancellation periods are based on the agreed offer, customer account or separate contractual documents. Unless agreed otherwise, fees are payable in advance. In case of late payment, access may be restricted or suspended.
8. Third-party services
iTable may integrate third-party services such as payment, email, SMS or WhatsApp, maps, analytics, hosting or cloud services. Additional terms may apply. iMATRIX GmbH is not liable for interruptions outside its control.
9. Data protection and processing on behalf
Where the customer processes personal data of guests, employees or business partners through iTable, the customer remains the controller under applicable data protection law. iMATRIX GmbH processes such data as a technical service provider on behalf of the customer where required for operation, support, security, billing and development.
10. Rights
All rights in iTable, the software, design, system components, trademarks, templates and technical concepts remain with iMATRIX GmbH or the respective rights holders. The customer receives a non-exclusive, non-transferable right to use the service for the duration of the contract. Customer content remains the property of the customer.
11. Liability
To the extent permitted by law, iMATRIX GmbH is liable only for direct damage caused intentionally or by gross negligence. Liability for indirect damage, consequential damage, loss of profit, data loss, business interruption, reputational damage, incorrect customer content or third-party claims based on customer content is excluded to the extent permitted by law.
12. Suspension and termination
iMATRIX GmbH may restrict accounts or functions if there is a justified suspicion of unlawful use, security risks, payment arrears or material breach of contract. Termination is governed by the selected package or separate contractual documents.
13. Changes
iMATRIX GmbH may amend these terms for legal, technical or operational reasons. Material changes will be communicated in an appropriate manner.
14. Governing law and jurisdiction
Swiss law applies, excluding conflict-of-law rules. The exclusive place of jurisdiction is Lucerne, Switzerland, to the extent permitted by law.
